1. Introduction

Welcome to KolBo. These Terms of Service (“Terms”) are an agreement between you and the company that operates KolBo (“we”, “us”). They apply to the KolBo website, the KolBo Clips, Toveedo Music, KolBo Studio and KolBo Ads apps, our mobile apps, the embeddable player and our APIs (together, the “Service”).

By using the Service you agree to these Terms, our Community Guidelines and any additional terms that apply to specific features, such as paid memberships. Please read them carefully. If you do not agree, do not use the Service.

This is a plain-language summary of how the Service works. Where a paid feature has its own terms, those terms apply in addition to these.

2. Who may use the Service

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use the Service only with the permission of a parent or legal guardian, who is responsible for your use.

Some features have additional requirements. For example, live streaming, monetization and paid purchases may require you to be older, to verify your account, or to be located in a supported country.

If you use the Service on behalf of a business or organization, you confirm that you are authorized to accept these Terms on its behalf, and “you” includes that organization.

3. Your account

You need an account to upload content, comment, subscribe and use most personalized features. Give us accurate information and keep it up to date.

  • Keep your password confidential and turn on 2-Step Verification.
  • You are responsible for activity on your account, including activity by anyone you allow to manage your channel.
  • Tell us promptly if you believe your account has been accessed without your permission.

You may create more than one channel under your account. Each channel must follow these Terms and the Community Guidelines.

4. Using the Service

We grant you a personal, non-exclusive, non-transferable license to access and use the Service as it is made available to you. When using the Service, you agree not to:

  • Access content through any means other than the player, pages and features we provide, or copy, sell or distribute content except as the Service allows;
  • Circumvent, disable or interfere with security features, access controls, or features that prevent or limit copying of content;
  • Use automated systems (bots, scrapers, crawlers) to access the Service in a way that sends more requests than a person could reasonably send, except public search engines following our robots rules, or as permitted by our API terms;
  • Manipulate views, likes, subscribers or other metrics, or pay or offer incentives to others to do so;
  • Collect personal information about other users without their consent;
  • Use the Service to distribute spam, malware or unsolicited promotional content;
  • Misuse any reporting, flagging, complaint or appeals process.

5. Your content

You keep ownership of the videos, comments, posts and other content you submit to the Service (“your content”). You are responsible for your content and must have all the rights needed to post it.

The license you give us

By submitting content, you grant KolBo a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (for example, transcode and create thumbnails or captions), distribute, publicly perform and display your content in connection with operating, promoting and improving the Service.

You also grant other users a license to access your content through the Service and to use it as the Service allows — for example, to watch it, share links to it, embed it (if you allow embedding) and create Moments of it.

Duration

These licenses end when you delete your content, except where the content was shared with others and they have not deleted it (for example, in a Moment you allowed), where we must keep it for legal reasons, or for a reasonable period while copies are removed from our systems and backups.

Removing content

We may remove or restrict access to content that we reasonably believe breaks these Terms or the Community Guidelines, or that could cause harm to users, us or third parties. When we do, we will tell you why and how to appeal unless doing so would breach the law, compromise an investigation, or cause harm.

6. Copyright and rights management

We respect the rights of creators and copyright owners and expect you to do the same. We respond to valid notices of alleged infringement and may terminate the accounts of repeat infringers.

If you believe content infringes your copyright, submit a removal request. If you believe your content was removed by mistake, you may submit a counter notification. Learn more in How copyright works.

7. Paid services

Some features cost money: KolBo Premium, channel memberships, video purchases and rentals, and fan-funding features such as Highlights, Stickers and Tips.

  • Recurring memberships renew automatically at the end of each billing period until you cancel. You can cancel at any time in Purchases and memberships; your benefits continue until the end of the current period.
  • Free trials convert to a paid membership at the end of the trial unless you cancel before then. Trials are available once per person.
  • Price changes for recurring memberships take effect at the start of your next billing period, and we will tell you in advance.
  • Purchases and rentals give you a license to watch the video through the Service. Rentals have a limited viewing window shown before you pay.
  • Fan funding payments are voluntary support for creators and are not refundable except where required by law.

Payments are processed by our payment provider. We do not store full card numbers on our servers.

8. Creator monetization

If your channel is accepted into the Partner Program, you may earn a share of revenue from ads, memberships, fan funding, video sales and Premium. Additional monetization terms apply, including eligibility requirements, content suitability rules and payout thresholds. We may withhold or adjust payments connected to invalid activity, such as fraudulent views or clicks.

9. Suspension and termination

You may stop using the Service at any time and can delete your account from Advanced settings.

We may suspend or terminate your access if you materially or repeatedly break these Terms, if we are required to by law, or if your conduct creates risk or legal exposure for us or others. Channels that receive three Community Guidelines strikes within 90 days are terminated. Where reasonable, we will notify you and explain how to appeal.

10. Changes to the Service and these Terms

We are always improving the Service. We may add or remove features, and may stop offering part of the Service, giving you reasonable notice where the change affects you significantly.

We may update these Terms to reflect changes to the Service, the law, or our business. We will give you notice of material changes at least 30 days before they take effect, except for changes needed urgently for security or legal reasons. If you keep using the Service after changes take effect, the updated Terms apply.

11. Disclaimers and limitation of liability

We provide the Service with reasonable skill and care, but content on the Service is provided by users and we do not guarantee that it is accurate, complete or available at any particular time.

To the extent permitted by law, the Service is provided “as is”, and we are not liable for indirect, incidental or consequential losses, or for loss of data, revenue or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD $100. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

12. Disputes and governing law

If you have a concern, please contact us first — most issues can be resolved quickly. These Terms are governed by the law of the place where the operator of the Service is established, without regard to conflict-of-laws rules, and you keep any protections your local consumer law gives you.
